TERMS AND CONDITIONS OF SALE BRYNAHERB™ ESSENCES LIMITED

All orders are accepted in accordance with the following conditions unless expressly excluded or varied by quotation. BrynaHerb Essences™ Limited accept no responsibility for errors or misunderstandings on orders not placed or confirmed in writing.

1. Application

These terms and conditions apply to all goods supplied by we of BrynaHerb Essences™ Limited to the you the customer named on catalogue or web site order form. The order form and these conditions form the only legally binding agreement between us and are concluded by our delivery of the goods to you.

2. Price

2.1
The price you pay is as shown in our current catalogue or web site at the time of order together with any carriage indicated on the order form or calculated on the website.

2.2
Unless you pay by credit/debit card, all cheques/Postal orders are to be made payable to BrynaHerb Essences Limited. This is to be sent with your order form or separate if you have sent this to us via e-mail. Goods will not be dispatched until you have paid for them.

2.3
Failure to pay will incur a monthly charge of 2.5% on all overdue monies.

2.4
Failure to pay will result in legal proceedings.

3. Delivery

3.1
Unless you instruct us otherwise we will deliver to the address shown on the order form. If you have not received goods within 10 working days of order please notify us.

3.2
All overseas orders will be subject to INCOTERMS.

4. Title

Legal rights to the goods will pass to you immediately prior to despatch of the goods.

5. Stocks

Occasionally we may have insufficient stocks to supply the goods you have ordered. We may if we think fit either supply a substitute product or refund the price you have paid as soon as possible.

6. Cancellation and Return of Goods

6.1
You are entitled without giving reason to cancel your order if you do so by e-mail or post to the address above provided you do so within 7 days of receipt of the goods by you.

6.2
If there is a problem with the goods please tell us when you cancel.

6.3
Unless the goods were wrongly supplied or substituted by us or are faulty, you are responsible for the costs of return, we are responsible in all other cases. In any event we will be happy to arrange a suitable carrier.

7. Limitation of Liability

7.1
This provision does not affect your statutory rights nor does it limit our liability for death, personal injury or fraudulent misrepresentation resulting from our negligence.

7.2
Otherwise if you notify us of shortage, damage or defect in the goods or advise us of non-delivery we will as directed either replace such goods or refund the amount paid by you.

7.3
We will have no other liability except as set out above.

8. Termination

If you fail to honour your obligations under the contract or if you are an account holder- become bankrupt or insolvent we may terminate our contract by written notice to you and at our option suspend further deliveries. In such event any monies, which you owe us, will become immediately repayable.

9. Unforeseen Circumstances

We shall not be liable to you for any failure by us to supply or deliver goods to you or in respect of any damage or defect to goods caused by any event or circumstances beyond our reasonable control.

10 Applicable Law

This contract shall be governed by and interpreted in accordance with the Laws of England and subject to the non-exclusive jurisdiction of the English courts.
